The McAlester City Council met in Special Session on Tuesday, January 9, 2007, at 5:30 P.M. after proper notice and agenda was posted January 5, 2007, at 5:00 P.M.

Present:            Don Lewis, Buddy Garvin, Sam Mason, Donnie Condit, Greg Rock, Travis Read, Haven Wilkinson & Robert Ivester

Absent:             None

Presiding:          Don Lewis, Mayor

Mayor Lewis called the Special Session to order.

Councilman Read moved to recess the Special Session for an Executive Session to discuss Wesley Brown settlement and other possible legal action in accordance with Title 25, Sec. 307.B.4, and discuss Collective Bargaining matters in accordance with Title 25, Sec. 307.B.2. The motion was seconded by Councilman Wilkinson, and the vote was taken as follows:

AYE:  Councilman Mason, Read, Rock, Condit, Wilkinson, Garvin & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Special Session was recessed at 5:31 P.M.

The Special Session was reconvened at 5:56 P.M.  Mayor Lewis stated that the Council had not completed its discussion but would recess the Executive Session until after the Regular meeting scheduled for 6:00 P.M.

Councilman Read moved that the Executive Session be recessed, to be reconvened following the adjournment of the Regular meeting scheduled for 6:00 P.M.  The motion was seconded by Councilman Mason, and the vote was taken as follows:

AYE:  Councilman Wilkinson, Mason, Condit, Garvin, Rock, Read & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Executive Session was recessed at 5:57 P.M.

Mayor Lewis asked for a motion to reconvene the Executive Session.  Councilman Condit moved to reconvene the Executive Session, seconded by Councilman Rock.  The vote was taken as follows:

AYE:  Councilman Read, Condit, Wilkinson, Mason, Rock, Garvin & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Executive Session was reconvened at 6:37 P.M.

Mayor Lewis reported that the Council had reconvened the Executive Session at 6:37 P.M. for the purpose of continuing the discussion concerning Wesley Brown settlement and other possible legal action in accordance with Title 25, Sec. 307.B.4, and discussing collective Bargaining matters in accordance with Title 25, Sec. 307.B.2.  Only those matters were discussed by the Council and no action was taken on those matters.  The Council returned to open session at 7:25 P.M., and this constituted the Minutes of the Executive Session.  Mayor Lewis stated that Councilman Garvin was excused at 6:55 P.M.

Councilman Condit moved to postpone any action on this matter until we can gather more information from the benefit program and the insurance program.  Councilman Wilkinson seconded the motion and the vote was taken as follows:

AYE:  Councilman Mason, Read, Rock, Condit, Wilkinson & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried.

There being no further business for the Council to discuss Councilman Condit moved for the Special meeting to be adjourned.  Councilman Wilkinson seconded the motion and the vote was taken as follows:

AYE:  Councilman

NAY:  None

Mayor Lewis declared the motion carried, and the Special Session was adjourned at 7:27 P.M.
