The McAlester City Council met in Special Session on Thursday, January 11, 2007, at 5:00 P.M. after proper notice and agenda was posted January 9, 2007, at 5:00 P.M.

Present:            Don Lewis, Sam Mason, Donnie Condit, Greg Rock, Travis Read, Haven Wilkinson & Robert Ivester

Absent:             Councilman Garvin

Presiding:          Don Lewis, Mayor

Mayor Lewis called the Special Session to order.

Consider Action to Void Professional Service Agreement with PBS & J of Dallas, Texas

Councilman Mason moved to void the professional service agreement with PBS & J, seconded by Councilman Rock.

Before the vote, George Marcangeli explained that PBS & J had run into some financial problems and the individual the City had been working with had left the company. 

PBS & J had never signed the contract nor done any of the work that was discussed.  He then stated that the City had requested the contract returned and it had been returned unsigned.

There was discussion concerning PBS & J and what would be needed to complete the first steps and continue with the Stormwater program.  It was also stated that the City would advertise for bids to complete the Stormwater Program and the company that had been contacted to complete the first step of the Program would probably submit a bid.

Councilman Mason stated that he had, had a conversation with an acquaintance that worked for an engineering firm in Tulsa and they had highly recommended Meshek & Associates, the company the City had contacted to complete the first step of the Program.

There was no further discussion, and the vote was taken as follows:

AYE¨ Councilman Mason, Read, Rock, Condit, Wilkinson & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried.

Consider Action to Approve Agreement for Engineering Services with Meshek & Associates for DEQ Phase II Stormwater Program for Fiscal Year 2007

Councilman Condit moved to approve agreement for Engineering Services with Meshek & Associates for DEQ Phase II Stormwater Program for Fiscal Year 2007.  The motion was seconded by Councilman Rock.

There was no discussion, and the vote was taken as follows:

AYE:  Councilman Wilkinson, Mason, Condit, Rock, Read & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried.

Councilman Condit moved to recess the Special Session for an Executive Session to discuss and interview City Manager applicants in accordance with Title 25, Sec. 307.B.1.  The motion was seconded by Councilman Mason, and the vote was taken as follows:

AYE:  Councilman Read, Condit, Wilkinson, Mason, Rock & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Special Session was recessed at 5:10 P.M.

The Special Session was reconvened at 10:05 P.M.  Mayor Lewis stated that the Council had gone into Executive Session for the purpose of discussing and interviewing City Manager applicants in accordance with Title 25, Sec. 307.B.1.  Only those matters were discussed by the Council and no action was taken.  The Council returned to open session at 10:05 P.M., and this constituted the Minutes of the Executive Session. 

There being no further business for the Council to discuss Councilman Condit moved for the Special meeting to be adjourned.  Councilman Rock seconded the motion and the vote was taken as follows:

AYE:  Councilman Rock, Read, Wilkinson, Condit, Mason & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Special Session was adjourned at 10:06 P.M.
