The McAlester City Council met in Special Session on Tuesday, April 24, 2007, at
5:30 P.M. after proper notice and agenda was posted on April 20, 2007, at 5:00 P.M.

Present:            Don Lewis, Sam Mason, Travis Read, Haven Wilkinson, Greg Rock, Buddy Garvin and Donnie Condit

Absent:             None

Presiding:          Don Lewis, Mayor

Staff Present:    Mark Roath, City Manager; Robert Ivester, City Attorney; and Cora Middleton, City Clerk

Mayor Lewis called the Special Session to order.

Councilman Mason moved to recess the Special Session for an Executive Session to discuss the Municipal Judge in accordance with Title 25, Sec. 307.B.1, and to discuss a land proposal in accordance with Title 25, Sec. 307.B.3.  The motion was seconded by Councilman Wilkinson.

Before the vote, Councilman Condit asked why the land matter could not be discussed in open session.

Mark Roath explained that a letter concerning this matter had been received in December of 2006.  He stated that he had spoken with the owner and was making the information available to the Council to see if they were interested in the City pursuing this matter.

Mayor Lewis stated that this land had not been offered for sale to the public at this time.  Councilman Mason stated that it was legal for the Council to discuss land in executive session.

There was no further discussion, and the vote was taken as follows:

AYE:  Councilman Mason, Read, Rock, Condit, Wilkinson, Garvin & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Special Session was recessed at
5:35 P.M.

The Special Session reconvened at 5:54 P.M.  Mayor Lewis reported that the Council had gone into Executive Session for the purpose of discussing the Municipal Judge in accordance with Title 25, Sec. 307.B.1, and to discuss a land proposal in accordance with Title 25, Sec. 307.B. 3.  Only those matters were discussed by the Council.  No action was taken and the Council returned to open session at 5:54 P.M., and that constituted the Minutes of the Executive Session.

There being no further business for the Council to discuss, Councilman Condit moved for the Special Meeting to be adjourned.  Councilman Rock seconded the motion, and the vote was taken as follows:

AYE:  Councilman Wilkinson, Mason, Condit, Garvin, Rock, Read & Mayor Lewis

NAY:  None

Mayor Lewis declared the motion carried, and the Special Session was adjourned at 5:55 P.M.
