Before completing this online form you must print this affidavit form and complete it. You will also need to attach a scanned copy of the 
affidavit using the File Upload at the end of the form and must be in JPG or PDF formats.

1. Application of street, alley, or easement closing may be obtained from the City of McAlester, Department of Planning.

2. Complete the application and submit it and the other required information (including names and addresses of all property owners within 300 feet, (the names and addresses must be done by an abstractor or abstract office) along with the filing fee (non-refundable). In addition, expenses (certified letters and publication) related to this application will be billed to you and must be paid prior to scheduled hearing date.

The application with all supporting data must be submitted by 5:00 P.M. at least thirty-two (32) days prior to the next meeting of the Commission. The Commission meets the third Tuesday of each month. 

3. At the next scheduled Planning Commission, your request will be considered at an official Public Hearing. YOU OR YOUR REPRESENTATIVE MUST BE PRESENT AT THIS MEETING! The Commission will hear discussion from you or your representative and others at the Public Hearing. At the conclusion of this discussion the Commission, by majority vote, will recommend that your request either be approved or denied.

4. A recommendation to approve the request will be put in ordinance form and submitted to the City Council for action. The City Council meets the second and fourth Tuesdays of each month. At this meeting, the official ordinance will be introduced and action will be taken. The street, alley, or easement is not officially closed until the City Council takes action.

5. A recommendation to deny the requested closing will not be forwarded to the City Council unless the applicant appeals to the Planning Commission decision. This appeal must be made within fifteen (15) days of Planning Commission action.

ORDINANCE NO. 2166

AN ORDINANCE AMENDING ARTICLE VII, SECTION 62-58, AMENDMENTS, OF THE McALESTER CODE OF ORDINANCES; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McALESTER, OKLAHOMA, that: 

SECTION 1: Article VII, Section 62-58, is hereby amended to read as follows:

a) Upon the filing of petition for closing, the property owner, or his duly
authorized representative, shall pay a filing fee to the Planning Commission. All fees collected by the Planning Commission shall be deposited with the City Treasurer and credited to the General Fund of the City. The fees and expenses for all public notices pursuant to such petition shall be paid by the petitioner, or his duly authorized representative, in accordance with the following schedule:

SECTION 2: Repeal of Conflicting Ordinance 
Any Ordinance now in effect that conflicts with any provision of this amendment is hereby repealed.
